Refund & Cancellation Policy

This Refund & Cancellation Policy explains how Avitara Realty (“we”, “us”, “our”) handles the cancellation of, and refund of, amounts paid to us online through the payment facility on avitararealty.com (the “Website”) in connection with the Avitara Elowoods project. It applies to booking amounts, tokens, application/registration fees and any other charges collected online, to the extent applicable to your transaction.

Please read this alongside our Terms of Use. Where you have signed a separate written agreement with us (for example an application form, allotment letter or builder–buyer agreement), the terms of that agreement govern to the extent of any conflict.

1. How to Request a Cancellation

To request a cancellation or refund of an online payment, contact us as soon as possible with your name, registered mobile number, payment reference/transaction ID and the reason for cancellation:

We will acknowledge your request and confirm the applicable refund amount, deductions (if any) and timeline in writing.

2. Refund Eligibility & Timeline

Where a refund is due, it will be processed to the original payment method used for the transaction. Approved refunds are initiated within [X business days — to be confirmed, e.g. 7–10 business days] of the refund being confirmed. The time for the amount to reflect in your account thereafter depends on your bank or card issuer and is outside our control.

3. Deductions & Charges

Refunds may be subject to deduction of [applicable processing / administrative charge — to be confirmed], any payment-gateway fees that are non-recoverable, and any statutory taxes already borne, as permitted by law and the terms applicable to your transaction. The net refundable amount will be communicated to you before the refund is processed.

4. Non-Refundable Amounts

Certain amounts may be expressly non-refundable or adjustable only against the final consideration, where this has been stated at the time of payment or in the agreement/booking terms applicable to you. Any such terms shown to you at the point of payment will prevail.

5. Real-Estate Bookings & RERA

Avitara Elowoods is a RERA-registered real-estate development (HP RERA Application No. PRO0120260004). Booking, allotment, cancellation and refund of a residential unit are ultimately governed by the executed application/allotment documents and the builder–buyer agreement, read with the applicable rules of the Himachal Pradesh Real Estate Regulatory Authority. This online policy covers amounts collected through the Website payment gateway and does not override those statutory or contractual terms.

6. Channel Partner Fees

Where a channel-partner joining fee or similar fee is paid online, its refund (if any) follows the specific terms recorded at the time of that payment.

7. Failed, Duplicate or Incorrect Payments

If a payment fails but an amount is debited, or you are charged more than once for the same transaction, please contact us with the transaction details. Verified failed or duplicate charges are refunded in full to the original payment method within [X business days — to be confirmed].

8. Changes to This Policy

We may update this policy from time to time. The “Last updated” date above reflects the most recent revision. The version in effect at the time of your payment applies to that transaction.
